破产法中劳动债权的相对优先性及其法律保障

On the Relative Priority of Labor Creditor's Rights and the Legal Protection in China's Bankruptcy Law

为适应破产立法的国际趋势以及促进市场经济的健康发展,2006年出台的《中华人民共和国破产法》采取了将担保权放在劳动债权之前清偿的立法模式,体现出立法者去"政策性破产"、立"市场化破产"的立法旨意。在市场化破产的趋势下,采用劳动债权相对优先主义的立法模式是具有其合理性的,但为了减少劳资矛盾与增进社会的稳定,仍应以现有的立法规定为基点,完善我国劳动债权优先权的实现机制与保障框架。

The Realization of labor creditor＇s rights in bankrupt enterprises is not only the important source to keep their own and family lives, but also indicates the states pay attention to the citizen＇s subsistence and development rights. In order to adapt to the international trend of bankruptcy legislation and to promote the healthy development of the market economy, ＂The People＇s Republic of China Bankrupt Law＂ passed in 2006 take the Legisla the legislato tire mode of the guarantee material creditor＇s right before the labor creditor＇s rights, reflecting rs to get rid of ＂the policy bankruptcy＂, and to establish ＂the market bankruptcy＂ intent. Under the trend of the market bankruptcy, it is reasonable to take the relative priority of labor creditor＇s rights legislation mode, but in order to reduce the labor and capital＇s contradiction and promote the social stability; we should be based on the existing legislations and perfect the implementation mechanism and security framework of the labor creditor＇ s rights.
