矿业是高污染行业,近年来我国对矿产资源进行大规模、超常规的开发利用,造成了矿山环境污染、生态环境急剧恶化、矿山环境问题日益突出等问题。环境保护可以保障矿区环境良好,矿产资源可以得以永续利用,但由于现行矿区环境立法存在体制缺陷、制度不完善、难以有效实施等问题,使得加强和完善我国矿山环境制度建设变得至关重要。为此,应通过建立严格的矿区环境准入机制,建立矿山企业自身环保机制,明确行政执法主体,通过调整矿山环境保护法律制度、完善矿区环境立法及充分发挥市场机制作用,完善行政监管、调控等相关制度,解决矿山环境问题突出的矛盾。
