摘要
占有具有正义、秩序、效率价值方面的意义,因此占有需要法律特别是物权法给予制度方面的保护。基于占有而产生的法律关系中的权利义务关系是对占有进行保护的法律基础。以此为逻辑起点,进而探讨物权法中针对占有保护的相关的制度设计。
Possession has the significance of justice, order and efficiency value, so it needs law, especially property Law to offer the protection of system.
