论民间法与国家法的冲突与协调

国家法由民间法发展而来,由于国家的加入,民间法和国家法出现了分野,同时产生了冲突、互动和融合。国家法与民间法的关系不是单向的,二者是互动存在的。国家法借民间法而落其根,坐其实;民间法借国家法而显其华、壮其声。但两者在现实司法实践中很多时候出现冲突,本文就该问题进行了分析,并提出了促使民间法与国家法相协调的途径。
