中国特色社会主义法律体系已经形成,司法成为法治建设的重心。这为我国法律方法论研究提供并营造了珍贵的时代机遇。本年度,法律修辞学和法律语言学受到了更多关注。传统的法律方法研究(如法律解释、法律推理、法律论证),越来越让位于贴近我国法律运行实践的法律方法论研究。随着研究的深入,法律方法的教学开始受到重视。在既有研究基础上,学界对法律方法论的研究领域不断扩展与延伸。我们应当抓住法律体系已经形成,法律方法论面临大发展之时代机遇,深入推进此研究。

With the establishment of the socialist system of laws with Chinese characteristics, justice has become the focus in the development of the rule of law in China, which provides a rare chance for the study of legal methodology. In 2011, more attention was paid to the study of legal rhetoric and legal linguistics, while study on traditional legal methodology such as legal interpretation, legal reasoning and legal argument gradually gave way to study of legal methodology more concerned over and close to actual legal practices in China. With the deepening of researches, legal methods education has attracted greater attention. On the basis of existing studies, the scope of legal methodology study has been expanding in width and depth. Researchers should seize the opportunity of the establishment of the socialist system of laws with Chinese characteristics and further advance the study of legal methodology.
