摘要
广东民间资本充裕,但现有正规投资渠道之外仍存在大量民间"非法集资"。与迫使其长期处于地下非法状态的严堵政策相比,有效的办法是对其进行合理疏导,建立直接融资下的合同监管模式,提供集资活动的丰富的公开信息,减少或尽可能杜绝非法集资的存在空间。同时,以违约赔偿责任和合同责任为救济手段,保护公众利益,使民间集资活动走入阳光地带,充分发挥其在多层次资本市场体系中的积极作用。
There is ample nongovernmental capital in Guangdong province, and besides legal investment channels; there simultaneously exists many 'illegal fund-raising activities'. By contrast to the prohibition policy, the effective strategies are to establish contract supervising model pursuant to direct finance policy, and provide abundant public information about financing deals, so as to reduce or even eliminate the possibility of illegal fund-raising. Meanwhile, default liability and contractual liability would be exhausted to protect public interests. The final target is to bring the nongovernmental fund-raising into sunshine zone, and bring it into full play in the multi- level capital market system.
