关于废除我国有关职务犯罪死刑的思考——兼议《中华人民共和国刑法修正案(八)》

Thinking About Abolishment of Death Penalty Concerning Occupational Crimes:Concurrently Discussing the Eighth Amendment to the PRC Criminal Law

文章在结合《中华人民共和国刑法修正案(八)》[3]分析我国职务犯罪的现实情况基础上,指出了废除职务犯罪死刑正当性理由。同时,从主客观两方面对目前我国废除有关职务犯罪死刑存在的现实困境进行剖析。最后,针对我国废除职务犯罪死刑提出构想和建议。

Based on the analysis of the actualities of occupational crimes in China in the light of the Eighth Amendment to the Criminal Law,this article points out the legitimate reason for the abolishment of death penalty,and at the same time makes an analysis of the actual difficulties for the abolishment from both subjective and objective aspects.Finally,the article comes up with some suggestions and ideas about the abolishment.
