摘要
牵连犯在我国立法上未作出明文规定,理论界存在多种观点,不能达成共识。本文对牵连犯的内涵、特征及处罚原则进行了探讨,分析了法学界的各种观点,经过考查认为对于牵连犯仍然适合从一重处断的处罚原则。
The term of implicated offense is not clearly stipulated in writing in the legislation of our country. In term of theory there are some different opinions that get no common view. The article approaches implicated offense from the connotation, feature and rules of punishment, analyzing different opinions in the field of law. One point is to adopt inflict punishment with one heavier crime to implicated offense.
