摘要
反就业性别歧视之根本目的在于实现男女工作权利的实质平等,对禁止就业性别歧视进行立法符合平等、正义等法的基本价值和精神。通过分析我国就业性别歧视禁止的必要性和可能性,明确反歧视的立法价值与理念,在此基础上对性别歧视的概念、范围以及认定和救济展开系统研究,从而为我国今后的反就业性别歧视立法和制度的体系化构建寻求可行性思路。
The fundamental aim of anti-sex-discrimination in employment is to achieve substantive equality between men and women in the right to work,legislative prohibition of sex discrimination in employment is in line with the basic values and spirit of equality and justice of law.Through analyzing the necessity and possibility of sex discrimantice prohibition in employment in our country,the paper clarifies the idea of anti-discrimination and its legislative value.On the basis of this,the paper explores systematically the definition,scope,affirmation and relieving of sex discrimination,in order to provide thoughts for the legislative and system counstruction of anti-sex-discrimation in employment in our country.
