摘要
我国高校法学教学中普遍存在理论与实践脱节的情况,教学中缺乏案例的讨论、分析与训练,这导致学生不能学以致用。普通法系的判例教学法不适合我国高校的法学教育,应采用大陆法系的案例教学法作为理论讲授的辅助方法。案例教学过程包括精选案例、精心准备、课堂讨论与分析、总结、考核等内容,应分为精选案例、深入剖析、课前布置、课堂讨论、点译考核五个步骤来进行,并需要建立和完善相关条件。
The disconnection between theory and practice generally exists in legal education of our country′s colleges and universities.The lack of case discussion,analysis and training in teaching results in students′ failure to apply their knowledge in practice.The precedent teaching method of common law system is not suitable for the legal education of our country′s colleges and universities.We should use the case teaching method as a helper method in theory teaching.Case teaching which includes selection of cases,careful preparation,class discussion and analysis,summary,assessment,should be divided into five steps in practice,and related conditions need to be established and perfected.
