航空配餐侵权涉及航空承运人、配餐公司、机场、安检人、航空器湿租出租人等多个主体,各主体的归责原则不尽相同。侵权主体不因受害人特殊体质而减轻或免除责任,除非受害人因此构成参与过失。侵权主体是否承担终局责任取决于主体的行为或营业特性、职责和法律目的等。责任份额不应以原因力为划分标准,而应根据风险比例规则确定。

Aviation catering tort relates to several tortfeasors, such as aviation carrier, catering company, airport, Se- curity checker,whose bases of duty are not the same, unless in an aircraft wet lease. The victim＇s special corporeity dose not influence his claimant, unless the victim owns the contributory fault because of this. Whether the tortfeasors undertake eventual liability, is determined by his character of act or business, and the aim of the law. The share of liability is not determined by the causal force, but by the risk proportion rule.
