摘要
"明刑弼教"学说直接凸显刑罚功能,远不如"德主刑辅"粉饰统治阶级"仁政"的效果,故而在宋代以前难以获得统治阶级的青睐。为强化封建国家的政治职能,朱熹密切关注古代法制体系的具体结构,对儒家传统的"德主刑辅"概念作了新的注解,对"明刑弼教"法制原则作了进一步阐发,添加了诸多新的内涵。
Exposing the penalty, combined with Confucianism＂ directly highlighted the penalty doctrine, far less the effeet of ＂ ethics -based, supplemented by the penal code＂ whitewashed the ruling class ＂benevolent＂ and therefore difficult to obtain the fa- vor of the ruling class before the Song Dynasty. In order to strengthen the political functions of the feudal state, Zhu Xi had been pay- ing close attention to the specific structure of the ancient legal system, giving a new annotation of the Confucian tradition t＇ethies - based, supplemented by the penal code＂, making a further elucidation of the principles of the rule of law on ＂ exposing the penalty, combined with Confucianism＂, and adding many new connotation to it.
