摘要
由于教师聘任制涉及的法律关系包括劳动关系、教育关系、行政关系和民事关系等,其可以适用的法律政策层次复杂、类型多样,且在聘任合同的期限、主要条款、合同的解除、经济补偿的情形、试用期以及争议的解决途径等方面存在较大冲突。为此,需要根据冲突法律规范的适用规则和原理对相关法律政策进行选择和协调。
It is complicated to how to apply laws,regulations and policies because there are a lot of intricate legal relations concerned,such as labor legal relations,education legal relations,administrative legal relations,civil legal relations and so on,under teachers' employment system.At the same time,there are also many conflicts concerning employment contract's term,main clauses,revocation,financial compensation,probation period,settlement of disputes and so on,in relevant laws,regulations and policies,among which,therefore,it is necessary for us to select or coordinate according to the conflict rules and principles.
