摘要
贾谊礼学思想贯穿着礼与法的矛盾。他认为礼与法在产生的顺序上不存在前后之别,两者皆术,同源于道,又皆是道,不存在尊卑之分。这也就否定了礼尊法卑位置关系,偏离了儒家的传统。然而在现实的政治社会中,他在强调礼法并用的同时,又强调礼法的主次之分,即又回到了儒家的传统。
The contradictions between rite and law run through JIA Yi's propriety thought. He thought that both propriety and law, occurring at the same time, have the same origin from Taoism, so there is no superiority and inferiority between them, which negates the principle that propriety is superior while law is inferior and deviates from Confucian tradition. However, he focuses on both equality and hierarchy of propriety and law in practical political society, so he goes back to Confucian tradition.
