刑法视角下的大学生犯罪与处罚

Analysis of College Student's Crime and Penalty from Criminal Law Perspective

大学生犯罪具有一般犯罪构成的特征,又因其主体身份而备受关注。对大学生犯罪处罚看法不一。大学生犯罪犯罪率和犯罪人数上升,并呈现出手段、类型多样化、动机复杂,危害行为智能化和暴力化的特点。以满足刑法适用的实际需要为出发点,采用规范分析的方法阐述基于大学生身份的从宽处罚背离了基本法治原则、违反刑事法律规范同时也不利于刑法任务及刑罚目的实现。

College student＇ s crime has been paid much attention because of the identity with the general elements of a crime. For different views to college student＇ s crime, the gradual upward rate and trend of college student＇ s crime, the complex of its means, variations and motives, intelligent dangerous actions and more violent crimes, based on the need of criminal law in reality, the paper puts forward the idea that the lenient punishment to the student＇ s crime is not proper for the identity of college students contrary to the fundamental rule of law, violations of criminal law and not conducive to achieving tasks and objectives of criminal law and penalty.
