中国对外直接投资政治风险的法律防范机制

China foreign direct investment politics risk's legal prevention mechanism

中国对外直接投资规模随着经济高速发展而迅速扩大,加强对外直接投资政治风险法律防范机制的构建已成为保护投资者安全与利益的必要前提和紧迫任务。本文结合对外直接投资政治风险防范现状和存在问题,从国内法和国际法两个层面提出了完善中国对外投资政治风险法律应对体系的对策建议。

With the fast economic development, the scale of OFDI increases rapidly in China. Strengthen- ing the legal system is not only a necessary prerequi- site to against political risk, but also a urgent task to protect security and interests of investors. Based on the analysis on the insufficiency and flaw existing in the present situation of legal protection system, the author proposes suggestions on consummating the legal system to prevent political risk from the aspects of domestic law and international law.
