摘要
清末民初的云南法治的运行,是变法和法治的博弈。云南地方政府用法律改良和广设司法机构来废除领事裁判权和改造社会,同时用严刑苛法、维护政治秩序、颁布法规严厉打击犯罪。云南地方政府加强对民族纠纷的处理,并严格安排司法费用。
The operation of law in Yunnan in Late Qing Dynasty resulted from the battle between the political reform and the rule of law. Yunnan local governments not only abolished consular jurisdiction and transformed society by modifying legislation and establishing the judiciary, but also severely implemented laws and cruel torture, maintained political order, and enacted laws to crack down on crimes. Meanwhile, they strengthened the revolution of ethnic disputes, and strictly arranged judicial expenditure.
