摘要
公共租赁房是国家为解决中低收入者的住房困难问题推出的一种新的保障性租赁住房。公共租赁房的发展离不开完善的立法支撑。针对当前公共租赁房立法存在的位阶较低,条文内容笼统,权利人保障措施缺乏等问题,需选择公共租赁房集中立法模式,确定法制统一、鼓励私人投资等立法原则,要在立法中明确国家是公共租赁房的唯一产权主体,把刚毕业的大学生群体纳入公共租赁房的适用范围。
Public rental house is a kind of subsidized rental house provided by the government for the low and medium income families to solve their housing problems, the development of which cannot do without legislation support. In view of the deficiencies concerning current public rental ho0se legislation, it is suggested to adopt the legislative principles of choosing concentrated legislative model, ensuring the unification of legal System, and encouraging private investment, clarify in the legislation that the country is the sole property subject of public rental house, include college graduates fresh out of school in the scope of public rental housing project.
