社区矫正作为一种与监禁矫正相对而言的刑罚执行方式,目前在西方发达国家已经成为一项重要的司法制度,基本实现了通过立法来对社区矫正进行全面的规制。我国对社区矫正进行立法具有可行性,立法的重点应聚焦在矫正队伍建设及人员素质、矫正措施和手段、财政保障机制以及社区矫正的法律监督等方面。

The community correction has become an important judicial system in the western developed countries, they has basicly realized the comprehensive regulation for community correction. It is feasible for China make legis- lation for community correction, the focus of the legislation should focus on the correction team building and quality of personnel, correction measures and means of financial security mechanism as well as community correction supervision.
