浅谈代孕合同之法律规制问题

Legal Regulations for Surrogacy Contract

随着人工生殖技术的发展,代孕在造福人类的同时也带来一系列法律上的问题,成为法学界一个崭新的研究课题。现实社会中已经大量存在着代孕行为及一些中介机构,然而我国对代孕合同的立法空白显然不符合时代需求,本文从代孕合同的概念入手,首先分析了代孕合同的合法化,之后提出了对代孕合同进行法律规制的构想。

With the development of artificial reproductive technology,surrogacy has caused lot of legal problems when it benefits human being,which has become a new issue in legal field.Although there exist practices and agencies of surrogacy,the legislative blank cannot meet the need of our time.This paper,starting from the conception of surrogacy contract,analyses the legalization of surrogacy contract and raises the thought of legalizing the surrogacy contract.
