对食品中菌落总数或大肠菌群超标的处罚探讨

摘要 《中华人民共和国食品安全法》(以下简称《食品安全法》)已经代替了《中华人民共和国食品卫生法》(以下简称《食品卫生法》),很多人在执法过程中发现,与《食品卫生法》相比,《食品安全法》将菌落总数和大肠菌群超标的食品在禁止生产经营的食品之外。对此,笔者认为只要改变《食品卫生法》时代对这一违法行为的处罚模式就可以处罚了(包括无生产日期或批号的即食食品)。同时该文对菌落总数和大肠菌群超标食品与"危害人体健康的物质"进了实质意义的区别。 After the"Food Hygiene Law of the People's Republic of China'has been replaced by the"Food Safety Law of the People's Republicof China",many people found out in the enforcement process that different from the "Food Hygiene Law",in the"Food Safety Law",the food with excessive total bacteria and Escherichia coli was not in the catergory of the food which should be forbidden to produce and sell. Yet the author believes that as long as the pattern of the penalties for the violations in the times of "Food Hygiene Law'is changed,the above offenses can still be punished (including instant food with no production date or batch). Meanwhile,the substantive difference between the food with excessive total bacteria and Escherichia coli and the "materials harmful to human health"has been described in the paper.
