论我国村镇银行法律制度的完善——兼评《村镇银行管理暂行规定》

Perfection of Bank Legal System in China:Comment on the Interim Provisions on the Administration of Village and Town Banks

在社会主义新农村建设中,金融的支持是农村经济发展的重要保障,村镇银行作为新型农村金融体系的重要组成部分,其法律制度的完善关系到自身的可持续发展和农村经济的长远发展。从村镇银行法律制度的价值出发,通过对我国村镇银行法律制度的现状进行分析和研究,比对《村镇银行管理暂行规定》与现实运行的差距,并在吸收国外村镇银行法律制度先进经验的基础上,为我国村镇银行法律制度的完善提出可行的建议和对策。

In the construction of socialist new countryside, financial support is an important safeguard of rural economy development. Rural banks are an important part of rural financial system, whose perfect legal system is related to the sustainable development of itself and the long - term development of the rural economy. This article, based on the value of village bank legal system, the analysis of the present situation of legislation about our country~ village banks and the comparison of the gap between the Interim Provisions on the Administration of Village and Town Banks and the reality, provides feasible suggestions for the perfection of our country~ village bank legal system by absorbing the advanced experi- ence of foreign countries on this side.
