摘要
从我国消费者索赔权概念着手,分析索赔权的现状,探讨消费者索赔权内容及我国《消法》存在的缺陷,提出完善索赔权制度的一系列建议,如完善消费者权益保护相关立法、完善消费者协会制度及相关行政部门对消费者维权案件的处理机制、完善仲裁制度和诉讼制度等。
This paper starts from China's consumers claim concept, then analyses the present situation of the claim, discusses the contents of consumers claim and defects of our country's Consumer Protection Law, and puts forward the perfection of claim system with a series of suggestions, such as improving consumer protection legislation, perfecting consum- ersJassociation rules and the relevant administrative departments of the consumer rights cases processing mechanism, and perfecting the system of arbitration and litigation system.
