On Procedural Safeguard upon Legislative Democracy,in Perspective of Local Legislation

立法程序作为立法民主的逻辑起点,对于理性型构立法意志具有重要的保障作用。在地方立法领域,由于保障不同,地方立法主体参与立法活动、立法听证、立法审议、立法表决等立法环节的程序设置存在明显的瑕疵,地方立法的民主程度有待提高。对地方立法机关活动程序及公众参与程序的民主化修复,有助于地方立法民主的实现。

Legislative procedure as the logic beginning of legislative democracy plays a very important role to rationally shape the legislative idea. In the area of local legislation, the democracy degree need to be advanced since there exists obvious procedural flaws safeguarding different body＇ s participating into legislative activities, legislative hearing, legislative review, legislative voting and other legislative circles. Democratization mending upon procedures of local legislative organs and public＇ s participating into the legislation will be beneficial to the realization of local legislative democracy.
