摘要
《联合国国际货物销售合同公约》确立了以期待利益保护为核心,信赖利益保护为补充的损害赔偿制度。本文围绕公约所确立的损害赔偿制度展开研究,在公约所确立的损害赔偿制度基础上,对公约确立以期待利益保护为核心的赔偿制度可行性和有效性进行了评析。
The United Nations Convention on Contracts for the International Sale of Goods establishes the expectation interest protection as the core and the reliance interest protection as a complement to the system of compensation for damage. This paper studies the damage compensation system in terms of the Convention, based on which, further analysis is made on the feasibility and validity of the compensation system with the expectation interest protection as the core.
