模拟审判属于法律教育的实践教学方式,评估是对该实践教学的过程监测与质量控制手段。基于模拟审判主客体间的交互性、复杂性,评估的维度多元化:以评估的目的论,宜用发展性评价或形成性评价,以考察学生潜能开发度、目标设置合理度;以评估的主客体论,主体有教师与学生,客体即模拟审判本身;关于学生的评估维度关涉知识与技能、程序与实体、理念与思维;关于教师的评估维度关涉诉讼构造释明、案件争点剖析、角色立场解读、实务技能评论;评估的方式有观察与访谈、测量与阅档、座谈与个案研究。评估的本质是作出价值判断。
