农村土地“外部承包”法律风险初探

Discussion on the Legal Risk of "External Contracting" of Rural Land

其他方式承包作为我国农村土地承包形式之一,是非农村集体经济组织成员通过"外部承包"参与农村土地开发经营的主要途径。现有土地制度下的"外部承包",由于承包者难以透彻了解土地法律制度而常面临诸多法律风险,包括超越范围承包,违反土地用途管制,土地权属不明,合同无效、被撤销或解除,未进行登记等。探讨这些法律风险,并提出具体防范措施,对于社会资本参与农村改革发展具有重大的现实意义。

As one form of land contracts in rural areas of China, contract by other means is the main ways for non rural collective economy organization members to be involved in rural land development and management by external contrasting.Under the current system, external contractors are faced with many legal risks due to the difficulty in understanding the legal system of rural land contract including beyond-the-range land contract, disobedient to land use control system, unclear ownership, and invalid contract, revoked or lift, no registration of land use rights, etc.This paper discusses these legal risks and proposes the specific preventive measures, which is of great practical significance for social capital in rural reform and development.
