未成年人社区矫正的检察监督

Procuratorial Supervision of Community Correction on the Minor

随着《刑法修正案(八)》将社区矫正在基本法中予以规定,社区矫正作为轻微犯罪的行刑方式今后也必将受到重视。无论成年人或未成年人社区矫正,目前均存在着实施主体和责任不明、缺少程序性规定、监督手段刚性不足等缺点。要加强对社区矫正的检察监督,必须改变低层次规范局面,在机关内部实现监督工作与自侦部门工作相结合,在机关外部做好建立工作联系机制、加强信息网络建设等工作。

With the prescription of community correction in the Amendment VIII to the Criminal Law of the People＇ s Republic of China, more importance will be attached to this kind of executive means for the misdemeanors. At the present stage, there exist such problems as unclear subjects, ambiguous responsibility and lack of proeedural provisions, etc. To reinforce the procuratorial supervision of community correction, efforts should be made not only to strengthen the cooperation between the self - investigation practice and the outside supervision, but also to enhance the external communication mechanisms.
