摘要
本文所指组织和利用邪教组织犯罪 ,是根据全国人大常委会《关于取缔邪教组织、防范和惩治邪教组织活动的决定》和“两高”《关于办理组织和利用邪教组织犯罪案件具体应用法律若干问题的解释》的精神及刑法的有关规定概括的 ,是指凡是组织和利用邪教组织实施的犯罪的总称。本文着重探讨了组织和利用邪教组织犯罪的共性 ,具体犯罪的个性特征及其与相关罪的界限 ,论证了对该类犯罪的处罚原则 ,以期正确区分罪与非罪、此罪与彼罪的界限。
In this article,the crime of organization and utilization of Heretical Cult Organizations is generalized on the basis of “Decision of the Standing Committee of National People's Congress on Banning Heretical Cult Organizations,Preventing and punishing Cult Activities”and “Explanations of the Supreme People's Court and Supreme People's Procuratirate Concerning Laws Applicable to Handing Cases of Organizing and Employing Heretical Cult Organization to Commit Crimes”It means all kinds of crimes of organizing cult organization and committing crimes.This article analyzes the generality of these crimes,individuality of individual cases,and the demarcation between crimes and non-crimes and between these crimes and other crimes,elaborates the principles of punishment of these crimes.
