工商行政管理机关应责无旁贷地运用国家赋予的权力来打击各种扰乱社会主义市场经济秩序的违法行为,但是在执法过程中行政自由裁量权的行使却出现了种种问题。文章通过对新时期行政自由裁量权存在的必要性和行使的困境进行分析,提出了一些具有现实意义的对策。

The industry and commerce administration authorities are entitled to exercise the authority of the state to punish all unlawful acts to harass the socialist market economic order,yet in the law-enforcement,the exercising discretion encounters many problems.The paper first analyses the necessity for the existence of administrative discretion in the new period and the dilemma in its exercising,then proposes some practical countermeasures.
