民间借贷中“转条”的性质探讨

Nature of Possession Transference Bill in Private Sector Borrowing

文章通过对民间借贷中"转条"性质的探讨,认为"转条"的性质是一种新的借贷关系。在司法实践中,应当根据个案具体问题具体分析,对案中"转条"的性质进行辨别,不能与计复利的欠条(借条)相混同,否则将产生不同的法律后果。

It is argued in this paper that the nature of possession transference bill is a new type of loan relationship.In judicial practice,the nature of possession transference should be defined based on the character of the case.It is not suggested to confuse this with the debt bill with compound interest.Otherwise,there will be different judicial outcome.
