论适龄儿童、少年是受义务教育的义务主体——“孟母堂事件”的再思考

On "School-age Children and Adolescents are the Obligor to Compulsory Education"——Rethinking on "Mengmutang Affair"

适龄儿童、少年(受教育者)具有接受义务教育的义务能力和责任能力。我国义务教育目的的"个人利益与国家利益的统一"决定了受教育者是受义务教育的义务主体。通过对外国宪法、国际人权法文件的比较分析,我们也可得出受教育者必须履行接受义务教育的义务的结论。

School-age children and adolescents have the ability to carry out the obligation and shoulder the responsibility of receiving compulsory education.The aim of compulsory education in China is for the individual and state interests,which makes the educated compulsory subject to compulsory education.We conclude that educatee must carry out the obligation to compulsory education by comparing the constitution and law of China with foreign constitutions and international documents about human rights.
