我国大学章程制定的现状与课题——以两岸四地若干大学章程为分析样本

On the Present Situation and Task of Formulating Chinese University Charter:An Analysis of the Samples in Four Areas

在篇幅与文本结构、外部关系要素、内部关系要素等方面存在诸多问题。大学章程面临的困境消解了章程规范和推动高校自主办学、妥善处理学校与政府关系的制度功能。为了保障大学章程内在功能的发挥,今后应从克服条文笼统、重视与政府、校友关系、实现学术自由等方面进行努力。

We analyzing the nine chapters of different universities from Mainland,Taiwan,Hong Kong and Macao,the problems in the process of chapter-enacting have been viewed in the length and structure,the external elements and internal elements.The dilemma university chapters face weakens their original functions of promoting the independence of universities and properly handling the relationship between schools and government.In order to give full play to the university chapters,some efforts such as overcoming the general statement of clauses,attaching importance to the relationship of government and alumnae and guaranteeing the freedom of academic should be paid in the future.
