基于法学视角的中国民办高校公司化运作探讨

民办高校是我国教育事业的重要组成部分,它兼具公益性和可营利性,有必要对民办高校进行分类管理。对于营利性民办高校而言,它完全可以实行公司化运作,但我国的相关法律规定还不完善,有必要作进一步的修订,使营利性民办高校拥有完整的法人财产权和健全的法人治理结构。

Civilian-run colleges and universities are an important part of Chinese education cause.They have both public welfare and profitability;thus it is necessary for them to carry out classified management,As far as the profitable civilian-run colleges and universities is concerned,completely,they can be operated with corporatization.However,our country＇s concerned laws with this respect are not complete for time being,so it is necessary to further revised so as to make the profitable civilian-run colleges and universities have complete legal person property rights and sound legal person governance structure.
