人肉搜索非犯罪化的伦理学分析

Ethical Analyzing on Decriminalization of Human Searching

危害行为的犯罪化需以伦理基础为支撑,不具有伦理可谴责性的行为不可能构成犯罪。人肉搜索具有整合信息资源、监督社会和引导社会道德发展的正价值,但同时也具有侵犯公民隐私、导致网络暴力的负价值。从目的价值的角度,大多数人肉搜索的动机具有伦理基础;从功利价值的角度,人肉搜索利大于弊。结合我国当前的社会发展状况及信息社会的特征,无论从信息社会的角度,还是从人肉搜索的工具价值角度、目的价值角度,人肉搜索都不构成犯罪。

Criminalization of harmful behavior should base on ethics,and the behavior which is not condemned by ethics is not possible to be criminalized.Human searching provides the positive functions of information resource coordination,society supervision and moral guidance;at the mean time,the negative functions of invasion of citizen privacy and possibility to bring about network violence.From the view of goal value,most motivations for human searching are oriented from ethics;and from the view of utility value,the advantages of human searching outweighs its disadvantages.Combined with current social development and the characteristics of information society,human searching should not be criminalized from the views of information society,tool value and goal value.
