摘要
为厘清船舶碰撞的法律责任,亦即是否满足刑法典第133条之规定构成交通肇事罪,航运界争议很大.运用海商法的经典理论和船舶航行技术规范,对海事行政管理部门的海事执法规范与司法机关刑事执法规范进行比较和分析,以解决船舶的航行自由和贸易自由在刑法理论体系中的规制问题,完善海事行政执法与刑事执法的衔接机制.
Making clear ship collision's legal liability which means defining ship collision as traffic accident crime with penalty according to the criminal law regulation of article 133 leaves lots of disputes.Through compareing and analyzing maritime administrative department's maritime enforcement standardization and judicial organ's criminal enforcement standard by the Maritime Law and navigation technology standard,the paper aims to solve the problem of regulation on navigation and trade freedom in order to improve the cohesive mechanism of maritime administrative enforcement and criminal law enforcement.
