对高校专利权流失现象的思考

基于对高校专利权严重流失现象的思考,通过分析借鉴国外高校的先进经验来进一步剖析其存在的问题,并提出我国高校专利权保护的若干对策:选择性申请,提高专利质量;明确权属关系,合理保护权益;妥善处理纠纷,遏制侵权行为;促进成果转化,防止专利权流失。

Based on a consideration of patent loss at colleges and universities and referring to the advanced experiences abroad,the current status of patent protection at China＇s colleges and universities is analyzed,accordingly several countermeasures are proposed as follows.Alternative application to improve the quality of patent.Ownership should be made clear to bring about rational protection of patent.Disputes should be well-handled to prevent from torts.Transformation of achievements should be promoted to prevent patent from loss.
