论农村土地承包经营权的流转方式

On the Ways of Circulation of Land Contract Management Rights

我国经济体制改革的目标模式是建立社会主义市场经济体制。资本、土地和劳动力是形成生产力的三种重要资源,或称三大生产要素,市场经济最终形成的标志就是这三大生产要素在主体上通过市场机制来配置。因此,如何建立、健全农村土地要素流转市场,推进农业生产要素的合理流转与有效配置,是发展我国社会主义市场经济进程中的重要问题。关于农村土地承包经营权的流转问题已越来越成为当前法学理论界研究的热点问题。笔者拟从土地承包经营权流转方式这一微观视角入手,探讨如何建立合理、科学的流转模式和体系,以期为土地承包经营权流转制度的完善起到促进作用。

The purpose of the economic system reform is to build the sociolist economy. Capital, land and labor force are the three important resources to compose productivity, which are also called the three factors of productivity. The sign of pletely forming the market economy is that the three factors of productivity is allocated through the market mechanism in the main body. Therefore, how to build, perfect the rural land circulation market is an important issue in the course of socialist market economy, so as to advance the reasonable flow and effective allocation of agricultural productive factors . The issue con- cerning about the circulation of the managerial right to contractual land has become the hot one for study in the academic law field, of the theoretical study of law. The author intends to explore the issue of how to establish reesonable and scientific circulation form and system from a micro perspective of the circulation form of the managerial right to contractual land, so as to promote the maturity of the circulation system regarding the managerial right to contractual land.
