摘要
我国刑事一审程序存在的多样性不足、难以满足实践需要的问题,影响着公正与效率两大诉讼价值的实现。为此,应当增设刑事和解从轻处罚程序,以确保刑事一审程序的功能作用得到充分发挥,实现公正和效率两大诉讼价值。相关制度的建构应该包括对和解案件的范围、和解的主体与主持人、相关参与人、和解的内容与效力、和解的监督和制约等内容予以规范;此外,对重刑案件也不宜一概禁止适用刑事和解从轻处罚程序,关键在于正确把握适用限度合理;至于对老年人犯罪案件如何适用刑事和解从轻处罚程序的问题,除极少数案件之外,可以适当放宽适用刑事和解从轻处罚程序的限制。
The lack of diversity in the criminal procedure of first instance in our country makes it hard to meet the demands of judicial practice,and this leads to the inability to realize the two litigious values of justice and efficiency.Therefore,we should establish a system of lenient criminal punishment based on reconciliation,so that we can bring into full play the functions of first instance procedure.Such a system should include regulations on the range of cases for reconciliation,subjects and directors of reconciliation,relative participants in reconciliation,contents and force of reconciliation,supervision of reconciliation,etc.Besides,we should not absolutely prohibit reconciliation and lenient punishment in serious crimes.The key lies in the proper application of reconciliation and lenient punishment.As to the application of the two in crimes committed by aged people,we can relax the restriction on lenient punishment to a proper extent.
