摘要
比较自合同生效取得土地承包经营权、地役权,明确通过约定方式确定建筑区划内规划用于停放汽车的车位、车库的归属,缺乏理论依据和现实依据。建筑区划内规划用于停放汽车的车位、车库的归属问题,说到底是不动产的物权归属问题,要遵循物权变动尤其是因法律行为引起的不动产物权变动的一般法理。对因法律行为引起车库(位)归属问题,宜采登记要件主义。
Although the right to the contracted management of land and easement shall be established since the contract thereon goes into effect.The ownership of the parking places and garages shall be not agreed upon by the related parties in the manners of selling,complementary using.The ownership of the parking places and garages is especially involved in attribution of the real right of a realty.The transfering of the ownership of the parking places and garages resulted from civil legal action is in accordance with basic principles of the creation,alteration,alienation or termination of the real right of a realty.Registration should be essential for the transfering of the ownership of the parking places and garages resulted from civil legal action.
