社区矫正与刑法价值实现

公正、谦抑、人道是现代刑法的三大价值目标,对其实现离不开刑事立法、刑事司法和刑罚执行等动态的法律运行环节。社区矫正的发展与演变伴随着刑法价值理念的转换。现代刑法价值对于社区矫正的催生作用,和社区矫正运行对于刑法价值实现的推动作用,是认识两者关系的不可或缺的两个方面。在刑法价值视角下,我国应着力处理好社区矫正的惩罚性功能与恢复性功能的关系,并通过立法保障和制度设计引导社区矫正走向。

Fairness, modesty and humanity are the three values of modern criminal law and can not be achieved without dynamic aspects of legal running including criminal legislation, criminal justice and punishment. Commuity corrections evolved with the conversion of criminal law values. The role of modern criminal law in the birth of community corrections and the promotion of community correction operation to the realization of criminal law values are essential to understanding the relationship between the two. In theview of criminal law values, China should strive to properly handle the relationship between punishment and rehabilitation in community corrections, and guide the development of community corrections through legislation and institutions.
