网络环境下中国电影版权的保护途径

中国电影业已经进入了数字化时代,电影制作、传播、发行都迈向了数字化进程。近年来,中国电影业取得了可喜的成绩,2010年票房收入突破百亿大关,标志着中国电影迈向了一个新的发展阶段。在网络环境下,电影与互联网的结合,使得电影传播具有传播渠道的多样性、传输过程的复制性、传受双方的互动性、影片观看的随意性等特点,但同时,电影版权侵权出现了新的类型,侵权方式由传统的音像制品的方式为主向以网络侵权方式为主转变。并由此加大了电影版权保护的难度。版权问题是电影行业正常发展的痼疾,网络环境下电影版权保护,需要从自我保护、法律保护、行政保护三个方面寻求解决途径。将三者保护结合起来,促进中国电影版权保护的发展。

The movie industry of China has come into the digital age, and the production, transmission, and issues of movie all turn out to be digital. In recent years, the movie industry has achieved a lot, with the encouraging re sults that box-office income has exceeded 10 billion in 2010, which shows that Chinese movies have stepped into a new developing stage. Combining of movie and internet makes the movie transmission have the characteristics： di versity in tunnel, replicability in procession, interaction on both sides, and freedom in watching. Film copyright infringement has a new type related to network, different from the traditional way of audio and video products, which makes the film copyright protection more difficult. So the copyright issue is still serious and the infringement is still rampant,which is the chronic illness of the film industry. Especially in network environment, the dis tribution of film presents new characteristics, resulting in a new tort problem. The paper discusses the way to protect Cinematic Rights with the aspects in self protection, legal protection, and administrative protection, and it is necessary to combine the three together for the development of copyright laws for films in China.
