On relationship between judge-creating law and local autonomy in Britain

英国法官的司法解释活动与地方自治的管理活动之间存在对立统一关系。英国地方自治委员会和地方法院乃至皇家高等法院之间的制衡关系,反映出英国城镇治理模式的自适性和独特性。通过实证分析的方法,对这种特殊的自治与治理关系中英国法官司法解释活动的能动性作用进行深入剖析,认为正是通过法官的司法解释,使英国地方自治委员会所操作的自治性法律与英国法官所维护的司法性法律相互制衡融合,促成了英国稳定的地方自治。

There exists contradictory and uniform relationship between the judicial interpretation activities of judges and the management activities of local autonomy in Britain.The check and balance relations between the local self-governing committees,the local courts,and even the Royal Supreme Court in Britain reflect the self-adaptability and specificity of the manage mode of cities and towns in Britain.Through empirical analysis,the active function of judicial interpretation activities of judges in this special relation is deeply analyzed between autonomy and governance in Britain.It is pointed out that just through the judicial interpretation of judges,check and balance and amalgamation are realized of the autonomy law implemented by local self-governing committees and the judicial law kept by judges in Britain,which promote the stably local self-government in Britain.
