法治既承载着传统伦理的价值诉求,具有伦理的价值表征,又受到传统伦理的深刻制约。等级特色的关系伦理,以德服人的执行伦理,顺应天意的宿命伦理,情、权滥用的程序伦理等制约着教育法制的创新与系统构建;而传统伦理的"责任义利","礼法互补,综合为治"的教化培养等观念,又有利于营造积极的教育法制化环境,在教育法制化进程中需加以彰显。
