学习中华人民共和国执业医师法后的几点见解

Viewpoints resulting from a study of Medical Practitioners Act of the PRC

通过学习中华人民共和国执业医师法后，深刻认识到：目前，应加深从法律关系高度认识执业医师法的立法目的和立法宗旨、纠正认识偏差、特别是不能将执业医师法片面理解为管理和限制医师或针对医师的法律，也不能孤立地当作是为了保护病人的法律。实施执业医师法的意义是促进医疗管理法治化和医院建设规范化及医院的内涵建设。要认真贯彻执业医师法，一是管理者树立法治观念，加强执业法制教育，带头学法用法，强化依法管理；二是医师要适应执业医师法的要求。

A thorough study of Medical Practitioners Act of the PRC(MPA) led us to the conclusion that at present it is imperative to understand the aim of this legislation from the high plane of legal relationships. It is incorrect to take a one-sided view of MPA as an act merely aimed at governing and restricting doctors or to take it in isolation as a law aimed at protecting the interests of patients. The significance of implementing MPA lies in Promoting the legalization of medical management and the standardization of hospital construction. TO thoroughly carry out MPA, managers should cultivate a strong legal sense, strengthen their education in laws on medical practice and enforce management by law while doctors ought to adapt themselves tO the requirements raised by MPA.
