孔子教化的法思想价值探析

Research on the Value of Legal Thought of Confucius Enlightenment

教化思想是孔子重要的法律思想。孔子通过改造礼法,将仁者"爱人"与"克己复礼"合为一体,推行德主刑辅,预防为先,宽猛相济,维持和谐等方式达到礼法教化与和谐秩序的统一。文章通过对孔子教化的法思想进行梳理、分析,以期发掘法哲学思想的价值导向。

Enlightenment thought is Confucius＇ important legal thought.Through transforming the etiquette,Confucius combined ＂benevolence＂ and ＂restraining oneself and restoring＂,carried out ＂virtue first,punishment second＂,made prevention first,held power leniently as well as strictly,and maintained harmony so as to unify etiquette enlightenment and harmonious order.Through arranging and analyzing the legal thought of Confucius enlightenment,the article intends to disinter the value orientation of philosophy of law.
