摘要
《劳动合同法》的通过有利于劳动者合法权益的保护,但该法在劳动合同解除中补偿金等问题上仍存在不足。通过对补偿金的性质和适用范围的分析,探讨补偿金在立法、标准、内容等方面的一些问题,有利于通过司法解释或进一步补充内容等去完善《劳动合同法》。
The labor contract law is good for protecting the legitimate rights and interests of workers,but it still has some deficiencies in the labor contract of compensation and other issues.This article analyzes the nature and the scope of compensation,discusses some question of compensation in legislation,standards and contents.We hope we can get new judicial interpretation or more perfect the legal content.
