土地承包经营权新探——浅析农村大学生毕业后在原籍的权利主体问题

The Land Contractual Management Right:The Subject Right of the Rural Students after Graduating

当前严峻的就业压力,致使大量原籍为农村的大学毕业生选择"返乡"。然而,由于户籍制度和宅基地管理制度的缺陷,以及村民自治权利的滥用,这个群体户口回到原籍后被转为非农户口,从而无法得到农村集体经济组织的成员权利,失去了应得的经济利益。土地承包经营权作为一项重要的农村集体经济组织权利,为落实其社会保障功能及体现法治社会的公平原则,应进行土地承包经营权主体相关法律规定的修改,达到有效保护"返乡"农村大学毕业生群体应有权利的目的。

Land Contractual Management Right is a kind of right for Chinese peasantry to possess and manage their land.And it is the embodiment for every farmer to hold his land Contractual Management of Chinese Rural Areas.But because of the defects of the household registration system and the system of house-site administration,the rural college graduates lose their subject right of the Land Contractual Management.Viewing from the current realities in China,from Social security Angle and the rule of principle of social justice,there are several solutions and amendment opinions.
