论学术期刊收取版面费的不违法性与合理性

On Legality and Rationality of Publication Fees Charged by Academic Journals

版面费的问题一直受到人们广泛关注,也给社会带来了一些负面影响。根据国家现行法规和学术期刊出版实际情况,从法和理两个角度对学术期刊收取版面费的问题进行了分析,认为在现实学术期刊"非事非企"的情况下,收取版面费既不违法,也有充分的合理性,有利于出版活动的正常进行。但是,针对"乱收费,滥收费,高收费"等现象,国家应该出台关于学术期刊收取版面费的规定和标准,并要建立健全监管机制和加强监管力度,使学术期刊收取版面费真正做到合法化、合理化、标准化。

The problem of publication fees has aroused the public concern and also brought about some negative influence in the society.According to the state＇s current laws and regulations and the fact of publication of academic journals,this paper,from the aspects of laws and theories,makes an analysis of publication fee of academic journals and holds that it is legal and rational to charge publication fee under the present condition that the units publishing academic journals are neither intuitions nor enterprises,but as for the phenomenon of charging fee arbitrarily,recklessly and excessively,the state should issue the rules and standards of charging publication fee,build up and improve the supervision and management systems and strengthens them in order to legalize,rationalize and standardize the charging of publication fee.
