论公共工程项目中公共利益的保障

Security of public interest in Public works projects

在以满足公共需要、提高社会福利为目标的公共工程项目中存在着一个双层多级的委托一代理链，即公众对政府的权力委托、政府对项目业主及项目执行团队的市场委托。由于委托一代理过程中的信息不对称性和契约的不完备性，公众委托的完整实现受到阻碍，其利益在项目建设寿命周期中也无法得到保障。本文从双层多级委托一代理链与项目基本建设程序的对应关系入手，结合用户满意度原则，分析项目寿命周期中公共利益保障的途径，提出在项目决策与设计阶段引入公众参与是切实保障公共利益的有效途径，系统开展社会评价是项目成功的必要构件。

Public works projects for the targets of satisfying public needs and improving social welfare have double multi-level principal-agent chains, namely, power entrustment between the public and government and market commitment between government and project execution team, because of information asymmetry and contract incompleteness, the realization of entrustment from initial principal （the public） is obstructed, public interest can＇t be guaranteed from infringement in the project＇s construction life cycle. From the corresponding relation between double multi-level principal-agent chains and project basic construction procedure, combing with user satisfaction principle, this paper analyzed the way of public interest security, put forward that the introduction of public participation in project＇s decision-making and design is the effective way of public interest security, launching social evaluation systematically is a necessary component of project success.
